View Full Version : Someone drove thru our yard last night! (I need some advice)

Well...late last night someone ran over our neighbors mailbox and drove thru our yard busting up our concrete culvert thing in our driveway and destroying our mailbox post and run into the neighbors yard across the street...the cops busted him down the road were he tried to flee but he had a busted tire and oil pan ripped out....I gave the cops our address and phone # and they said they would stop back by sunday night for a written statement from us.

I was wondering who will pay for my property damage? What should I do?

u will probably have to pay unfortunately.
Unless they catch the guy convict him and then sue his insurance it may take a while before any of that gets done.

His auto insurance Liability should have to pay you.

You all are assuming that the guy has insurance.

If the guy has auto insurance, it should cover it, especially since the police made a report. If he doesn't have insurance, you can sue him, but that will also cost you probably just as much as the damage, in lawyers fees.

Make a claim on your homeowners insureance.

The answer is "You". You may press criminal charges for your place. Chances are it's a Maliscious Mischief, unless it's over the $ ammount that bring it to a fleony (Varies state to state) You may also press civil charges against them. I would do so if I were you. Never know....They may be rich.

if hes insured, its his auto. if hes not, make a claim with your homeowners insurance and then it becomes their resposibility to go after him to get paid for the claim
