Jim,

It has come to my attention that a fellow Fins Fan made a purchase of a alleged signed Marino Jersey from you through ebay. We understand that every signature cannot be exactly the same, but he signed jersey he recieved was not even close. The several Marino signatures that I own are severly far apart in comparison.

I do not, in anyway, want to question you on how you run your business, but that jersey is not authentic. We want to believe that it was a simple mistake and that you did not intentionally sell a fake jersey. Please allow the purchaser to obtain his money back or replace the jersey with an authentic one.

Thank you for your time on this matter.
excellent email! let him know we here at Finheaven are aware of what happened and that his Dolphins merchandise may sit there for a long time if this isn;t correct as soon as possible. Alot of Dolphin Fans will see what type of buisness he runs.

contacting your local TV 'problemsolvers' might also be a course of action, they love this type of thing. Better yet, contact the local TV in the sellers market-perhaps they could pay him a visit at home with a camera and ask him where he learned his atugraph expertise

check www.paypalsucks.com

paypal got hit with a big lawsuit and most people that had accounts with them got a piece of the lawsuit money.

They can freeze your account when they please and take money out of it, etc... their so called secruity on their site is not even protected against homemade hacking programs. But if you like and trust your money with them, go right ahead. Read their Rules and Regulations and such and maybe that will change your mind.

I haven't read all the responses, however this is a good idea. Contact the seller, and make him aware that you know this a phony. Contact ebay to let them know about this as well. Ebay will feed you full of nice ideas to fix this by contacting the seller, if they gaffed you once, they will do again. Ebay doesn't do enough to correct problems when they come up. Do like BurghPhin fan says here, or a local newspaper. If you hear nothing from the seller, and they don't try to make it right, protect others from thief, and leave him negative feedback, make it as percise as you can so others don't get ripped off as well. If feedback was already left, you can still go in under that item number, and leave one more additional feedback. Good luck, and sorry to hear what happened.

You can also contact the Better Business Bureau, and also report this to your local postmaster. Hang in there, it maybe a lot of work, but hopefully you will get somewhere.

I didn't see where you left any feedback yet. Try to work it out first. If you search for the seller on ebay he goes by the seller name of ADELEDOG, could small letters. I couldn't remember!

Ideas

First of all I am assuming your mom sent in a check so she can't stop payment. I am in the industry and would recommend the following:

1) Be nice. Contact him and let him know that you don't believe the item is real and are willing to let a third party decide. Companies like PDA and Global Authenticated will authenticate the signature. If it comes back fake ask if he will take it back. If not sue him for fraud.

2) Ask where and how he got the signature. He claims that he was out of jerseys. Well Marino hasn't done any signings recently so where did "they" come from.

3) If you want to be a jerk with the help of this fan site we can bid and win all of his items on ebay. Then none of us will send him any money. We threaten to continue to win all of his items without payment until he refunds your money. He won't be able to survive if we do this.

Advice to all collectors. 85% of all autographs are fake 90-95% of all autographs on ebay are fake. We have photos from every autograph signing we hold with pictures of the athlete and the exact date and time of the signing. We now copyright all of our pictures because people were stealing them and using them as there own on ebay. A COA is garbage. It is just a piece of paper.

Finally, find out the return policy of the companies. We give full refunds for the first 5 business days after a client receives an item. Last, we joined the BBB Online program. If a company is a member they are required to have a return and exchange policy to be allowed in the program. We actually amended all of our policies for the benefit of the customer so we could get accepted.

This guy is a joke. I looked at some of his other 'autographs' and many of them look like the same person wrote them! This guy is a total fraud, and hope he gets what he deserves.

Mr. Darr,

I am writing to you concerning a fraudulent transaction you recently engaged in with a fellow Dolphin fan and friend of mine's Mother; item #5144385505.

I have personally seen the signature in question, and am aware of the circumstances surrounding the transaction. As an owner of 6 peices of signed Dan Marino memorabilia, all of which were signed by Dan in my presence, it is clear that you have provided my friend with a fraudulent, fake peice of merchandise, and misled/took advantage of my friend's Mother, the purchaser.

I am a member of a Dolphins fan club who's membership exceeds 7,000 people, as is my friend. I am aware that you have received e-mails from some other members already. You can expect plenty more. You can also expect a full boycott of your e-bay store, and swift retribution on the part of my friend.

You see, Mr. Darr, our membership is comprised of people from all walks of life... but many of us have a legal background. We have advised our friend of his rights, and have instructed him on the correct processes to follow to bring about swift action to rectify the situation.

I assure you, you do not want to go down this path. My advice to you at this point is to do the right thing, either by refunding him (his Mother's) money, or providing him with an authentic peice of memorabilia with an authentic Dan Marino signature.

You have probably received about 10 e-mails by now from members of our fan club supporting our friend. As I previously stated, there are over 7,000 of us... so you can expect to receive another 6,990 e-mails if this matter continues to go unresolved; not to mention the actions we have suggested to our friend to take.

You need to do the right thing here. Please, take my advice. 7,000 against 1 are not good odds.

Sincerely,

NY_FinFan_72
