DHS Approves Seizure of Cell-Phones & Laptops Within 100 Miles of Border

Americans have no Fourth Amendment rights against unreasonable searches and seizures if they happen to be within 100 miles of the border, according to the “Executive Summary” of a still-secret report by the Department of Homeland Security (DHS). As the ACLU-created map above shows, nearly 2/3 of Americans (197 million people)—including the entire populations of Florida, Maine, New Hampshire, Vermont, Massachusetts, Connecticut, Rhode Island, New Jersey, Delaware, Maryland, Washington, DC, and Michigan—live in this “Constitution free” zone, as do the residents of the nation’s five most populous cities: New York, Los Angeles, Chicago, Houston and Philadelphia.
The secret report is DHS’s response (two years late) to critics of its policy, in place since at least 2008, of allowing border control agents, without a warrant or even a suspicion of wrongdoing, to search any travelers’ electronic devices (laptops, cell phones, tablets, cameras, etc.) and seize data they find. According to a Freedom of Information Act request (FOIA) filed three years ago by the ACLU, DHS subjected more than 6,500 travelers—nearly half of them U.S. citizens—to searches under this policy between October 2008 and June 2010.

Eventually those "Safety Zones" will cover the entire map.

Inch by inch they are stripping away the constitution. No right to protest when the secret service is in the area, 100 miles of the boarder no search and seizure lol. No right to representation if you are engaged abroad with a 'terrorist" organization and it is deemed (not proven) that you are a threat, you have tte right to own whatever gun "we" say you can.

I'm not certain how the large majority of the population can sit complacently by while the rights that were fought so hard for a slowly being stripped away.

Why does the DHS even exist still? It was a failure. Wasnt the department created as a think tank against terrorists attacks? Pool minds and resources to find ways to prevent and stop attacks? What they found was: we dont have alot of terrorist attacks. It should have been dissolved then. Instead of doing the logical thing and assigning their duties/procedures/practices to other agencies, they have expanded their duties.

Back on subject, to be fair even in the article it admits the Supreme Court ruled it was Constitutional. We might think its bull****, but its not against the law of our land....at least according to this version of the Court.

We're in Obama's 5th year. He had a friendly Congress for his first two years. Yet this attack on our Constitutional Rights still exists.

Obama is right - we DO have a failure of leadership in this country!

DHS spokesman Jason Ciliberti says the ACLU’s description of the zone as "Constitution-Free" couldn’t be further from the truth and that the check points follow rules set by Supreme Court rulings.

"We don’t have the abilitty to just set up checkpoints willy-nilly," Ciliberti said. "The Supreme Court has determined that brief investigative encontuers do not constitute a serach or seizure."...

The courts, however, are not on the ACLU’s side — and have regularly ruled that the Fourth Amendment’s protections don’t extend to the border area, airport screening or even to laptops at the border.
Crappy, but legal according to the Supreme Courts interpretation of the Constitution.
