Is Pornography an abuse of the First Amednment?

Its an interesting debate. Pornography is one of the most consumed products in the United States, but should it really be covered by the 1st amendment? How exactly is it freedom of speech? Where is the speech part? As far as I am concerned, its just legalized prostitution, and the only reason its kept around is because of the economic impact. If prostitution is illegal, I can think of no reason why pornography is legal.

I dont believe it really should be considered free speech because it has no intellectual value.

So what are your thoughts on the subject?

I have no problem with it. I just want it to be as difficult as possible for children to access it.

I can see your point about it being similar to prostitutions, but they can say it is just acting and they are just playing a role same as any other mainstream actor.

Plus you are buying a video copy of what took place not the actual prostitute. I would think there has to be a difference.

I dont see why it shouldnt be covered under freedom of speech, or expression. If the standard is whether or not it has any intellectual value then we are in trouble because most things have little to no intellectual value. And who gets to judge whether it has intellectual value or not?

On the one hand it is a product offered to those who are interested in it and are willing to pay for it. On the receiving end it is a behavior of choice, which has certain expectation of freedom to it. That would be covered under amend 1.

Players come and go, but I will always be a Miami Dolphins Fan first and foremost.

Prostitution isn't illegal everywhere, it's left up to the states. Ditto pornography. PErsonally, I think the government should stay out of both excpet for regulation.

I don't think pornography should be compared to the First Ammendment whatsoever. This goes with the whole violence on TV. I think it should be kept away from children (porn; for obvious reasons), but not by the government... it should moderated or in control of the parents. I don't see any physical harm with pornography, and I think the government shouldn't get involved. I don't know why the government gets involved with gay marriage either. They make such a big deal out of it. Let those who view pornography continue to, let homosexual couples make their own decisions, and keep religion away from government.
