    Supreme Court Asked to Reconsider 'Partial Birth' Abortion Case

    The Bush administration has asked the Supreme Court to reinstate a ban on "partial birth" abortions, setting up a showdown that could be decided by the president's new choice for the court.

    The appeal, which had been expected, follows a two-year, cross-country legal fight over the federal law.

    An appeals court in St. Louis said this summer that the ban on late term abortion is unconstitutional because it makes no exception for the health of the woman.

    The Supreme Court has already scheduled arguments in November in another abortion case, involving New Hampshire's parental notification statute. That case also asks whether the state law is unconstitutional because it lacks an exception allowing a minor to have an abortion to protect her health in the event of a medical emergency.

    There is no provision for the womens health so it was struck down. Change the language of the law and it is back on the books

    Anyway, it should be banned.. Its a gruesome practice, and if they are putting people in jail for throwing infants in dumpsters, they should do the same to anyone doing partial birth abortions because its the same exact thing..

    As for the health of the mother stipulation, I can see it both ways.. A parent should want to sacrifice their own life for the sake of the child, cuz in the end, that IS the point of life.. To further your genetic line, at any cost..But, I can understand not all people would want to sacrifice themselves for the sake of their child, and that is quite a decision, so I feel that should be left to the parent's discretion as well.. That would literally be their life on the line as well, not the same as the old "her body" argument of typical abortions..
